Welcome to HomeUtilities (“App”), operated by Rise1116 Pvt. Ltd. (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the App, which allows you to upload photos for analysis using external optical character recognition (OCR) and large language model (LLM) systems to provide suggestions. The App is subscription-based with a free trial period, managed through in-app purchases via Apple App Store and Google Play Store, and uses your Google or Apple account for authentication without requiring separate profile creation. The App has no age restrictions.

By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

 

By using the App, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. These Terms apply to all users, including those accessing the App via Google or Apple login.

The App is accessible to users of all ages, with no age restrictions. If you are a minor in your jurisdiction, you represent that you have the consent of a parent or legal guardian to use the App. Parents or guardians are responsible for supervising minors’ use of the App.

 

– Authentication: To use the App, you must log in using your Google or Apple account. We do not require you to create a separate profile within the App.

– Account Security: You are responsible for maintaining the security of your Google or Apple account credentials. We are not liable for any unauthorized access resulting from your failure to protect your credentials.

– Accuracy of Information: You agree to provide accurate information through your Google or Apple account for authentication purposes.

The App allows you to:

– Upload photos (which must not contain personally identifiable information or “PII”) for analysis.

– Receive suggestions based on backend analysis using external OCR and LLM systems.

You agree to use the App only for lawful purposes and in accordance with these Terms. You must not:

– Upload photos containing PII or content that is illegal, offensive, or violates third-party rights.

– Attempt to reverse-engineer, modify, or interfere with the App’s functionality.

– Use the App in a way that could harm, overload, or impair our servers or systems.

– Subscription Model: The App operates on a subscription basis with a free trial period. Subscriptions are managed exclusively through in-app purchases via the Apple App Store or Google Play Store.

– Payment Terms: All payments, including subscription fees and renewals, are handled by Apple or Google. You agree to their respective payment terms and policies.

– Free Trial: The free trial period is provided as specified in the App. After the trial, your subscription will automatically renew unless canceled through the Apple App Store or Google Play Store.

– Cancellation: You may cancel your subscription at any time via the Apple App Store or Google Play Store. No refunds will be provided for partial subscription periods unless required by applicable law.

– Price Changes: Any changes to subscription pricing will be managed by Apple or Google, and you will be notified as per their policies.

– App Ownership: The App, including its design, code, and content (excluding user-uploaded photos), is owned by Rise1116 Pvt. Ltd. or its licensors and is protected by copyright, trademark, and other intellectual property laws.

– User Content: You retain ownership of the photos you upload. By uploading photos, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and analyze the photos solely for providing the App’s services (e.g., OCR and LLM analysis to generate suggestions).

– Restrictions: You may not copy, modify, distribute, or create derivative works from the App or its content without our prior written consent.

– Google and Apple Authentication: Account authentication is managed through Google or Apple login services. Their respective terms and privacy policies apply.

– OCR and LLM Providers: We use external OCR and LLM providers to analyze uploaded photos. These providers are bound by agreements to protect your data and use it only for the intended purpose.

– Apple App Store and Google Play Store: Subscriptions and payments are managed by Apple or Google, and their terms of service apply.

– Content Guidelines: You are responsible for ensuring that uploaded photos do not contain PII or violate any laws or third-party rights (e.g., copyright, privacy).

– Compliance: You agree to comply with all applicable local, state, national, and international laws while using the App.

– Prohibited Conduct: You must not misuse the App, including by uploading malicious content, attempting to gain unauthorized access, or engaging in activities that disrupt the App’s functionality.

We may suspend or terminate your access to the App at our sole discretion, with or without notice, if you violate these Terms or engage in activities that harm the App, other users, or us. Upon termination:

– Your right to use the App will cease.

– Any active subscription must be canceled through the Apple App Store or Google Play Store.

– We may delete your uploaded photos and related data, subject to our Privacy Policy.

To the fullest extent permitted by law:

– The App is provided “as is” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

– We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including loss of data, profits, or goodwill.

– Our total liability for any claim related to the App will not exceed the amount you paid for your subscription (if any) in the preceding 12 months.

You agree to indemnify and hold Rise1116 Pvt. Ltd., its affiliates, officers, directors, employees, and agents harmless from any claims, liabilities, damages, or expenses (including legal fees) arising from your use of the App, violation of these Terms, or infringement of third-party rights.

– Governing Law: These Terms are governed by the laws of State of Maharashtra, India, without regard to conflict of law principles.

– Dispute Resolution: Any disputes arising from these Terms or your use of the App will be resolved through binding arbitration in state of Maharashtra, India. You waive the right to participate in class actions or class-wide arbitration.

We may update these Terms periodically. Changes will be posted in the App with the updated effective date. Continued use of the App after changes constitutes your acceptance of the revised Terms.

– Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and Rise1116 Pvt. Ltd. regarding the App.

– Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.

– Assignment: You may not assign your rights or obligations under these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

– No Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
